Advocates in Eastern\nEquatoria State have expressing mixed reactions over a letter by the\nDirectorate of Land and Town Planning, in the Ministry of Physical\nInfrastructure, to bar them from the right to offer contract agreements to\nclients.<\/p>\n\n\n\n

On June 29, Juma Babikir\nLohure, Director of Land and Town Planning, wrote a letter to the advocates, notifying\nthem that all contract agreements for the sale of plots and change of\nownerships, not verified or signed by legal competent advocate and Commissioner\nfor Oath, shall not be accepted by the department at the ministry.<\/p>\n\n\n\n

\u201cAnybody who comes to you\nwith such document, not endorsed by a competent Commissioner of Oath recognized\nby the Hon Chief Justice of South Sudan Judiciary, should not be accepted at\nyour end,\u201d Added Babikir in his letter.<\/p>\n\n\n\n

Addressing the Press, Acting\nSecretary for Eastern Equatoria Advocates Association, Beda Kasimiro Anthony,\nsays the consequences of such order are much greater, stressing that it has\nbetrayed the public as it triggers many reactions from advocates.<\/p>\n\n\n\n

\u201cThere is no jurisdiction\nall over the world where an advocate is licensed and things like drafting\ncontracts is denied. After all what is drafting contracts? Even an ordinary\nperson can draft a contract, public there, members there can draft a contract\nand it is said to be valid,\u201d explained Beda.<\/p>\n\n\n\n

He quotes that section 34 of\nthe Contract Act 2008 of South Sudan provides that a contract can be both oral\nand written. <\/p>\n\n\n\n

For his part, Ustaz Simon\nFredrick Pasquali, Legal Advisor in Torit, comments that the letter addressed\nto them rapidly affects their businesses with clients.<\/p>\n\n\n\n

Meanwhile, Advocate Juma Joe\nAdriano, working for Centenary Associated Advocates, says the advocates demand\nan apology from Babikir.<\/p>\n\n\n\n

\u201cWe request him to be\nsomeone who is neutral, because what he has stated in the order here is\nsomething different, that talks of powers of the Commission of Oaths. It is not\ntalking about barring the advocates from drafting the agreement,\u201d added Juma.<\/p>\n\n\n\n

According to Juma, after\ngathering information, advocates will sit together to launch the case to the\nPublic Prosecution to resolve the matter amicably, or else pursue to high court\nin case of disagreements.<\/p>\n","protected":false},"excerpt":{"rendered":"
