Dr. Machar raises concerns on fair-trial, challenges Special Court rulings in ongoing case

Former First Vice President Riek Machar Teny has questioned the fairness of the ongoing trial involving him and the other co-accused.

He alleged political interference, unequal treatment of the defense, and restrictions affecting his case preparation.

During his defense before the court during the 120th session, Machar said his concerns were not caused by losing confidence in his defense team. Instead, he cited court rulings and developments that raised questions about the proceedings’ independence.

Machar also questioned the growing role of co-opted advocates in the prosecution. He said Ministry of Justice prosecutors appeared to have taken a secondary role.

He asked whether the advocates were acting on behalf of the state and questioned if the case was effectively becoming a private prosecution.

He said he had no objection to additional lawyers assisting the prosecution. However, he insisted the case must remain one brought by the State.

Machar also raised concerns about the alleged political affiliations of some prosecution team members. He said their involvement created an appearance of political interference.

Machar argued that some prosecution lawyers were associated with the governing SPLM-IG. He said they were prosecuting members of the opposition SPLM-IO.

Machar cited several court decisions that he described as politically motivated. They included restrictions on recording, defense communication, and media coverage.

He also challenged decisions concerning the court’s jurisdiction and the First Vice President’s immunity. He further questioned his designation as an accused person and investigations into alleged mass violations.

Machar told the court that an alleged plot to assassinate accused persons had been uncovered. He said members of the defense team were also reportedly targeted.

Machar described the situation surrounding the trial as “toxic.” He called for a proper investigation to ensure everyone’s safety.

Despite his concerns, Machar said he still hoped the court would deliver justice. He thanked the court for respecting several rights of the accused.

Machar praised the court for allowing accused persons to dress decently during proceedings. He also thanked the court for permitting writing materials and independent legal representation.

He urged the court to base its final decision on facts and evidence. He said political pressure should not influence the court’s judgment.

The proceedings were adjourned to Wednesday, October 14, when Dr Machar will continue with his presentations.
